New York state law

What state law says about local solar, wind and storage rules. Each statement links the law or official source it comes from.

State siting: Office of Renewable Energy Siting and Electric Transmission (ORES), Department of Public Service

Wind and solar of 25 MW or more must get a state siting permit from ORES instead of town approvals.

N.Y. Public Service Law article VIII (RAPID Act, 2024); 16 NYCRR 1100-1.2(bb). Source

Limits on local rules

For projects ORES permits, it can decline to apply a town law it finds unreasonably burdensome in view of the state's climate targets; the applicant must justify each request.

Solar standards in state law
